What is Paternity?

Paternity refers to the legal recognition of a man as the biological father of a child. Establishing or setting up paternity is the process used to confirm who is the legal father of a child or refuting allegations that an individual is a biological father. Establishing paternity is vital as it grants fathers certain rights and responsibilities, such as custody, visitation, and financial support.

How is Paternity Established?

When a woman is married, her husband is legally presumed to be the father of the child. However, if the parents are not married to each other at the start of the pregnancy or the birth of the child, the paternity of the father needs to be established by genetic testing.

If no genetic testing is requested by a party, paternity can be established if both parents sign an Acknowledgment of Paternity. However, if the mother is married to a man who is not the natural father of the child, the husband must also sign a denial of paternity.

If an individual is unwilling to submit to genetic testing or sign the acknowledgment of paternity, a judge can also order the paternity of an individual. This process is started by filing a petition for paternity in district court and requesting the judge to order genetic testing on the father and the child.

The Importance of Establishing Paternity

Establishing paternity is not only crucial for fathers but also for children and mothers. Children can benefit emotionally, financially, and socially when they have a legal father in their lives. They gain access to critical benefits such as healthcare, inheritance, and social security benefits. Moreover, fathers gain the opportunity to build a meaningful relationship with their children.

It is important to establish paternity as soon as possible but it is also important to start legal proceedings immediately if you have any doubts or concerns that you are not the biological father of a minor child. Some exceptions apply but you may be unable to challenge a presumption of paternity after two (2) years.
